REGULAR MONTHLY MEETING
March 11, 2010


Chairman Steve Hackl called the regular monthly meeting of the Cicero Town Board to order at 7:30 p.m. All board members present. The clerk and treasurer were also present.

GUESTS Attending the meeting were Larry Kettner and an officer from Outagamie County Sheriff department.

MINUTES Motion made by Steve Hackl and seconded by Tom Oskey that the minutes be approved as corrected. Motion carried and approved.

TREASURER’S REPORT Motion made by Steve Hackl, seconded by Tom Wagner. Motion carried and approved that the treasurer’s report be approved as printed.

APPROVAL OF BILLS It was motioned by Tom Oskey to pay all bills for the month of March. Seconded by Tom Wagner. Motion carried and approved.
FENCE REQUEST (L&M INDUSTRIES) Chairman Hackl received a letter/partition from Noel Marcks and George Lorenz of L&M Industries. With this, they requested the Town to require/assist with the installation of a barbed wire fence between the business and surrounding residences. Steve forwarded the partition to the Town attorney for review. After review, the attorney sent Steve his opinion on the matter. The attorney stated that this partition only applies when the "adjoining lands are used and occupied for farming and grazing purposes". This is not the case here. The partition, under Statute 90.05 does not obligate the Town to do anything. It is between the owners of the adjoining land. The attorney letter is available for anyone who would like to read by contacting the clerk. Steve Hackl made a motion that the Town takes no further action in the matter of the fence. Tom Wagner seconded. Motion carried and approved.
BUILDING INSPECTOR Chairman Hackl received a fee schedule from Jim VandenHeuvel and shared with the other board members. Steve drafted a letter/contract between the Town of Cicero and Jim. Per the contract, all fees are to be paid to the Town and Jim will bill the Town for his costs. A letter of termination will be drafted and sent to Mike Miller. Motion made by Tom Oskey to contract with Tom VandenHeuvel as our new building inspector. Motion seconded by Tom Wagner. Motion carried and approved.
WELL WATER TESTING Received a letter from Clear Water Testing offering testing to the Town residents. Chairman Hackl went over the fees listed in the letter. They would set up at the Town Hall, distribute the water sample bottles, and collect them and the necessary fees from residents that wish to participate. Steve Hackl made a motion to set a date for well water testing. Tom Oskey seconded. Motion carried and approved.
SET DATE FOR OPEN BOOK & BOARD OF REVIEW Need to contact Rick Pauls to find out his availability before the dates can be set. Treasurer offered to call Rick.
SET DATE FOR ANNUAL MEETING The date for the annual meeting is set for Tuesday, April 13, 2010 at 8pm.
SUBDIVISION ORDINANCE UPDATE (COMP. PLAN COMM) The Comprehensive Plan Committee recommends that the Town wait on a subdivision ordinance until Outagamie County complete the revisions they are doing to the Farmland Preservation plan. Some of the Town concerns about subdivision may be addressed in the revisions.
APRIL ELECTIONS 2010 The clerk requested approval for three election workers for the polls on April 6, 2010. The only item on the ballot is Seymour School district elections. Steve Hackl made a motion to approve three poll workers for the April elections. Seconded by Tom Wagner. Motion carried and approved.


CORRESPONDENCE
- There have been some recent thefts of some new Town road signs. The sheriff’s department has been notified and extra patrols will be out.
- Town of Seymour contacted Chairman Hackl regarding the split of the maintenance of Lawn Road. They asked to put on record as to how we maintain it vs. the divided version. Steve informed them to go ahead and put on the record.
- Chairman Hackl submitted a Prevailing wage determination for the Old 47 project. Determination should be received in a few weeks.
- Replacement of two culverts will occur this spring. Estimates have been mailed to all parties.
- Chairman Hackl spoke with a representative at CenturyLink about the ‘blanket application’ for line installation. It has been amended to state repairs for residential home is fine. Specific request required if lines are in Town right of way.
- The board members were advised of some upcoming seminars and training opportunities.
- The TRIP funds of $30,890 have been received. Wanting to redo the remaining 2 miles of Old 47 from VV to Shady Road with these funds.
- DOT sent out information on the safety project grant available. It is strictly for improvements involving safety issues.
- Town received four notices from the County regarding the cutting of timber. They are just informational notices.
- The clerk received the Smart Growth Reimbursement check from the City of Seymour.
- The clerk informed the board as to the credit balance the Town has with Badger Energy.

ADJOURN Motion was made by Tom Wagner, seconded by Tom Oskey to adjourn. Motion carried and approved to adjourn at 8:52 p.m.
