REGULAR MONTHLY MEETING
February 11, 2010
Chairman Steve Hackl called the regular monthly meeting of the Cicero Town Board to order at 7:30 p.m. All board members present. The clerk was present; the treasurer excused.
GUESTS There were 13 guests in attendance, including Tim Roach of the Outagamie County Zoning Administration and Bob Weyenberg, the County Board Supervisor for our area.
MINUTES Motion made by Steve Hackl and seconded by Tom Oskey that the minutes be approved as read. Motion carried and approved.
TREASURER’S REPORT Motion made by Tom Oskey, seconded by Tom Wagner. Motion carried and approved that the treasurer’s report be approved as printed.
APPROVAL OF BILLS It was motioned by Tom Oskey to pay all bills for the month of February. Seconded by Tom Wagner. Motion carried and approved.
MARGIE MARCKS – L&M INDUSTRIES Chairman Steve Hackl read the letter received by the Town attorney. The letter stated that the Town is under the zoning of the County. If the Town were to want their own zoning ordinances, the expense would be great. The Town would have to create a committee and have someone on payroll for overseeing of the committee. After the reading of the letter, Margie Marcks presented to the board further pictures for her case. The complaint continues to be the broken down equipment that is parked on the property lines of the neighboring residences. Another argument is that the property is not being run as a farm but strictly as a business. Tim Roach from Outagamie County Zoning helped field these questions/concerns. First, he stated that the interpretation of the ordinance for this business is that a manure handling business is an agricultural business. The location of this type of business, most logically, is out in a rural area. Tim Roach explained extensively the ordinance of zoning for the L&M Industries. Stated that he or the zoning committee cannot just go in and force them to put in a berm or require them to move the equipment. Tim further explained because the business is ‘farm related’ they did not have to go before the County Zoning to get approval, as another business may be required to do. If the residents want to take further action, they would need to go before the Appeal of Adjustment board at the County level.
Resident Joe Kania, at the advice of his attorney, wanted to address the board and be included in the minutes. He wants the board to be advised of his concern for the safety of his 3-year old child. The child is attracted to the tractors. He is afraid his child will get hurt should he crawl on. The residents brought up that the tractors could be considered an ‘attractive nuisance’, and would fall under the same guidelines as a swimming pool does. Joe commented that he watches his child the best he can and hopes a fence gets put up soon. An officer from the Outagamie County Sheriff’s office was present during this and commented on Mr. Kania’s responsibility of control of his child.
With all said and done, Chairman Steve Hackl made a motion that the Town takes no further action in this matter at this time. Tom Oskey seconded the motion. Motion carried and approved.
FIRE DEPT (MABAS RESOLUTION) There was an Addendum to the Mutual Aid Box Alarm System Agreement (MABAS) presented to the Board. This agreement is between the Town of Cicero and the Nichols Rural Fire Department in regards to assistance. Steve Hackl made a motion to accept and sign the addendum. Tom Wagner seconded the motion. Motion carried and approved.
BUILDING INSPECTOR Chairman Hackl made some inquiries. He has left messages back and forth with the building inspector, Jim VandenHeuvel who works with the Town of Osborn. They have left messages back and forth with each other thus far, asking and answering questions. It sounds as though this person is interested in working with the Town of Cicero as well. Chairman Hackl will work on getting a contract put together.
HANDICAP RAMP UPDATE The clerk made contact with GAB (Government Accountability Board) as to the grant funds. The current federal regulation for this type of grant is that these funds can only be used for a portable ramp. The funds cannot be used for improvements on a permanent structure. Therefore, it was suggested that we research to see if there is anyway a portable could be used at our location. The board asked the clerk to get more literature and possibly pictures of the portable ramps so a better determination could be made. Clerk will bring to March meeting.
SUBDIVISION ORDINANCE As of today’s date, the Town of Cicero does not have a Subdivision Ordinance. Currently, land that is in general ag could be made into a subdivision. The question brought in front of the board was does the Town want to have a subdivision ordinance. There was discussion at to the different stipulations the Town could make. Chairman Steve Hackl will follow up with the Comprehensive Plan committee; have them do some research and report back to the Town Board.
APPROVAL FOR TRAINING FOR POLL WORKERS The clerk asked for prior approval for some upcoming training Outagamie County will be holding for the poll workers. This training will count towards the poll workers required hours needed to work at the polls. There is no fee charged by the County for this training. Tom Oskey made the motion to approve attendance of training by Outagamie County by the poll workers. Motion seconded by Tom Wagner. Motion carried and approved.
CORRESPONDENCE
Steve reminded the Board members of the upcoming Town Association meeting on February 20th in DePere.
Chairman Hackl received a letter from the Department of Revenue stating they would be doing a field review of some of the Town properties. They will randomly select a sample of properties and do a field appraisal. This is done to ensure the Assessor is valuing the properties fairly and correctly.
Chairman Hackl received a letter from the State regarding assessors and that they will be reviewing the quality of the assessments.
Fox Valley Technical College is appointing board members if any one is interested.
Chairman Hackl reviewed a few notices of some upcoming conferences or meetings if any board member was interested.
Centurylink, fka CenturyTel sent the Town a blanket application for approval for some construction beginning in May, 2010. The contract was vague as to what, where, when so this needs to be followed up on to get more information before signing.
Clerk received a call from Officer Mike Fitzpatrick of the Outagamie County Sheriff Department regarding Kuhn Kennels. He wanted to inform us that he did an inspection of the property. All was neat and clean. He also followed up with their vet and was informed that all dogs are vaccinated and healthy. He has no violations to report at this time. They will be doing periodic inspections. Other officers, as well as the Humane Society, have been instructed to contact him with any complaints.
The Clerk reminded the Board members to turn in there quarterly expenses prior to the next meeting.
ADJOURN Motion was made by Steve Hackl, seconded by Tom Wagner to adjourn. Motion carried and approved to adjourn at 9:15 p.m.
